Draft dated 28 October 2026. Not for publication until registration details and release checks are complete. Effective date: [date].
These Terms govern the relationship with Individual entrepreneur Anna Harashchenko (FOP Harashchenko Anna Anatoliivna), Ukraine (the “Operator”) for the parent and child GPS Tracker & Locator apps. Address: [postal address]; registration: [FOP registration details]; support and privacy: [working email]. The separate Privacy Policy explains data processing.
Parent accounts are for adult parents and legal guardians. Registration requires a valid email address and the adult's phone number; they are used to contact you about the account, subscription and security. The child app may be installed only on a minor child's device where that adult has the necessary parental authority. A family invitation does not itself grant guardianship rights.
Monitoring adults, including a partner or spouse even with consent, employees, or other people's children is prohibited. The service is not for secret surveillance or intercepting other people's conversations.
Depending on settings, features include maps, location history, geofences, SOS, text and media chat, screen time, domain filtering, unknown-call protection and live Radio.
This is a supporting tool, not a substitute for personal supervision or emergency services. SOS sends parents an internet notification; it does not call emergency responders. Accuracy, delay and availability depend on networks, phones, batteries, permissions and operating systems. Uninterrupted service is not guaranteed.
Before enabling Radio, the adult must explain microphone operation, recipients and stopping controls to the child and obtain all permissions and consents required by law. Separate initial setup permits remote activation without confirmation of each session, including when the screen is locked.
A ready notification indicates Radio availability; during transmission it states that parents can hear audio. Audio passes through the server and short memory buffers; Radio creates no recording file or archive. Chat voice messages are a separate recording and storage feature.
Sessions are not limited to five minutes, but parents must stop them as soon as the specific purpose is met. Technical ability to listen for longer does not permit disproportionate or continuous monitoring. Transmission stops on session termination, leaving the screen, loss of connectivity, or disabling the microphone/service.
The child can disable access through Settings → What parents can do → Technical transmission settings → Allow microphone for Radio (Ukrainian labels in the app). Hiding notices, circumventing withdrawn access or misleading the child about microphone use is prohibited.
The recording prohibition applies to live Radio, not voluntarily created chat voice messages. Children's and other individuals' rights also apply to chat. These Terms do not remove rights or duties that cannot legally be restricted, including compliance with a binding lawful demand from a competent authority; this is not general permission to record sessions.
Within applicable law, the parent or guardian is responsible for their decision to listen, its lawfulness and proportionality, required authority and consents, external recording or sharing contrary to these Terms, and harm caused by those actions. Pressing a button does not establish that every use is lawful.
The Operator remains responsible for its own conduct and duties concerning the service, security, processing transparency and user rights. These Terms do not transfer the Operator's responsibilities to parents or waive mandatory law. The app does not guarantee technical prevention of external recording.
Network or GPS limitations do not remove mandatory consumer rights or liability that cannot lawfully be limited. These Terms neither legalise prohibited use nor guarantee Google Play approval.
Price, period, renewal, payment and cancellation must be shown before purchase. A test implementation does not establish working payments. Subscription terms and provider: [complete before paid launch]. Refunds follow applicable law and the actual store's rules; no unconditional refusal of refunds is imposed.
On an abuse report or reasonable suspicion, the Operator may restrict a feature or account to protect the child and investigate. Requests and appeals: [working email].
Account deletion: Menu → My account → Delete account; outside-app request: [URL]. After deletion the Operator keeps a minimal client record (email, phone number, device identifiers, dates, subscription status) to prevent abuse, including obtaining the free period again; details are in the Policy. Retention and residual copies are described in the Policy. Unpairing a phone, deleting an account and cancelling a store subscription are separate actions.
Code, design and Lumi belong to the Operator or relevant rights holders. Users receive a limited right of personal family use. Maps and third-party components have their own licences.
Ukrainian law applies without removing mandatory consumer protection in the user's country of residence. Users may contact the Operator to resolve disputes; access to courts is not restricted. Invalidity of one provision does not invalidate the remainder.
Material changes are disclosed before application. Changes to sensitive-data processing requiring consent need a separate affirmative action. Language versions must be consistent, and no language rule limits mandatory consumer rights.
